UPDATE, 2/5/2021 Montgomery County Council Considers Re-Zoning in Communities Near Metro StationsRezoning Could Limit Municipal Zoning Authority and Allow Multi-Family Dwellings and Increased Density in the Village Links to Templates for Individual Written Testimony Last month, we advised residents that Montgomery County Councilmember Will Jawando had introduced Zoning Text Amendment 20-07 (ZTA), which would allow owners of R-60-zoned properties located within 1-mile of a Metrorail station to build “Missing Middle” housing types, including duplexes, townhouses, and multi-family structures within the current R-60 lot coverage, building height, setbacks, minimum lot size and minimum parking requirements. Additional zoning flexibility is also proposed for R-60 zoned properties located within one-half mile of a Metrorail station, including exclusion from infill lot coverage limits and decreased minimum onsite parking requirements.
All of the properties in the Village are currently zoned R-60, which are residential lots with a minimum area of 6,000 square feet and a minimum width of 60 feet, creating a fairly dense housing pattern. The Village’s zoning authority to regulate building height, mass, setbacks, lot coverage, etc., is limited to single family zoning. If adopted, it is possible that this ZTA could eliminate or drastically decrease the Village’s existing zoning authority and our ability to regulate new buildings and changes to existing buildings in the Village. Additionally, the proposal could have impacts on stormwater runoff concerns in the Village (by reducing permeable surface area) and tree canopy (as the proposal seeks denser development).
Residents may view ZTA 20-07 on the council’s website at https://www.montgomerycountymd.gov/COUNCIL/Resources/Files/zta/2020/ZTA%2020-07.pdf.
Important Dates: Planning Board and County Council Hearings
- On February 4, the Planning Board received a report from Planning staff, held a Public Hearing and outlined what will be the Planning Board’s recommendation to the County Council regarding ZTA 20-07. To view a recording of the meeting, visit http://mncppc.granicus.com/MediaPlayer.php?view_id=2&clip_id=2370 (begins at minute 3:43:20) and the Planning staff’s report can be viewed at https://montgomeryplanningboard.org/wp-content/uploads/2021/01/ZTA-20-07_Final.pdf.
- The County Council will hold its Public Hearing on February 11. County residents may submit written testimony to the County Council via email to county.council@montgomerycountymd.gov. Written comments must be submitted no later than February 9.
A coalition of affected municipalities and communities has provided a template letter opposing the ZTA, which can be downloaded at the following link. The template need not be used to provide comments to the County Council. Councilmember Jawando—who introduced the ZTA—has produced a “Fact Sheet” regarding the ZTA (and an accompanying “anti-rent-gouging” bill) that can be viewed online at: https://www.chevychasevillagemd.gov/Archive.aspx?ADID=870

Tips for Enjoying the Super Bowl, Safely
The CDC has issued the following guidance for safely enjoying this weekend’s Super Bowl during the COVID-19 Pandemic:
Gathering virtually or with the people you live with is the safest way to celebrate the Super Bowl this year. If you do have a small gathering with people who don’t live with you, outdoors is safer than indoors. This year, choose a safer way to enjoy the game. Host a virtual Super Bowl watch party.- Wear clothing or decorate your home with your favorite team’s logo or colors.
- Make appetizers or snacks with the people you live with to enjoy while watching the game and share the recipes with your friends and family.
- Start a text group with other fans to chat about the game while watching.
Attend an outdoor viewing party where viewers can sit 6 feet apart.- Use a projector screen to broadcast the game.
- Sit at least 6 feet away from people you don’t live with.
For more guidance regarding small gatherings, visit: https://www.cdc.gov/coronavirus/2019-ncov/daily-life-coping/holidays/small-gatherings.html

MCPS Reexamines Boundary Study to Explore theReassignment of Students from Somerset Elementary School to Westbrook Elementary SchoolFive Proposed Options; Online Survey Ends February 16 Last winter, we informed the community that Montgomery County Public Schools (MCPS) had determined that Somerset Elementary School is over capacity and the school system had begun a boundary study process in an effort to relieve the capacity pressure by reassigning students to Westbrook Elementary, located west of River Road and south of Little Falls Parkway. Last November, the Board of Education authorized expanding the study to include Bethesda Elementary School, which is also operating over capacity. Earlier this week, MCPS staff presented information regarding the current capacity concerns at Somerset and Bethesda Elementary Schools along with five options for the reassignment of students to relieve the capacity pressure by transferring some of the school’s feeder zones to Westbrook. The presentation can be viewed here: https://www.youtube.com/watch?v=lWaScgl5S_Y&feature=youtu.be. Any reassignments would begin after improvements are completed at Westbrook Elementary, which is slated to be completed in September 2023.
Five reassignment options were presented. Option 1 would reassign a portion of Chevy Chase Village to Westbrook Elementary. This includes homes west of Cedar Parkway between Oliver Street (to the north) and Western Avenue (to the south). Only homes located west of Cedar Parkway along West Lenox, Grafton, and Hesketh Streets would remain assigned to Somerset Elementary School under Option 1.
The remaining proposed options would not impact the current assignment of students within the Village: options 2-5 would have no impact on Village households (those currently assigned to Somerset Elementary School would maintain their current school assignment). Residents—regardless of whether you currently have a student in MCPS—are encouraged to respond to the survey at https://mcpsweb.wufoo.com/forms/w1dfd1hx1lm1akz/. After reviewing responses to this survey, MCPS will determine whether to present an additional round of options. The deadline for responses is Tuesday, February 16 at 11:59 p.m. Anyone interested in this matter is encouraged to visit the boundary study page at: https://www.montgomeryschoolsmd.org/departments/planning/BethesdaSomersetWestbrookBoundaryStudy.aspx for more information.
